“Small city with big problems”: Oxnard Residents March to Community Relations Commission, Police Department to Demand End to Brutality

Bereaved Mother Displays Son’s Photo Indicating that Brutal Beating Played Role in Son’s Death, City of Oxnard and Police Covering-Up Foul Play

(OXNARD, CA) On Monday, August 20, 2012, over a hundred local residents gathered in Oxnard’s Plaza Park before marching through downtown and into City Council Chambers to denounce police abuse and brutality at the Community Relations Commission (CRC) meeting. The community strongly conveyed that the CRC must carry out its mandate, “to promote better human relations among all city residents,” and ensure that these issues be placed on the next agenda of the Oxnard City Council. The community marched to the Oxnard Police Department headquarters where they powerfully chanted “Killer Cops, Off our Streets!” and similar slogans for approximately 30 minutes before returning to the park.

The Commission originally informed the Oxnard-based Todo Poder al Pueblo Collective that there were going to be formal presentations on the matter, and that the issue of severe misconduct on the part of the Oxnard Police Department (OPD) was going to be an item on the agenda. However, four days prior to the meeting, organizers were informed that interim City Manager Karen Burnham, City Attorney Alan Holmberg, and Chief of Police Jeri Williams had met and decided to block the item. Despite this setback, the community persisted by testifying on their experiences of police brutality and laid out its demands during the public comment segment of “items not on the agenda.”

The community’s core demands mandated systemic change to Oxnard Police Department practices in order to halt the ongoing pattern of police abuse and brutality.  Additionally, the community called for the establishment of an independent, community-based, Police Complaint Review Board with the power to take action when police officers mistreat or harm the community in any way.

The bereaved family of Robert Ramirez, who died in the custody of the Oxnard Police Department on the night of June 23, 2012, spoke out and made an anguished appeal for an independent investigation of his brutal death. Concerned that Ramirez was possibly experiencing a drug overdose, family friends who were seeking medical attention called 911. Eye witnesses (who wish to remain anonymous) informed the family that they saw what appeared to be Tasers used on the young man, in addition to the savage beating of the handcuffed Ramirez by seven to ten Oxnard Police officers.  A poster-sized photograph of the deceased Robert Ramirez was presented by the family before the CRC clearly indicating extensive facial bruising and physical trauma – evidence that the young Ramirez had been severely beaten prior to his tragic death.

Robert Ramírez’s Death in Custody of Oxnard Police Department Raises Question of Brutal Practices

Choking back tears, Teresa Ramirez stated that the OPD’s current practices could claim the lives of Commission members’ children, grandchildren, nieces, or nephews if OPD brutality isn’t put to an end. The grieving mother noted, “I’m not saying that every single police officer in this town is brutal and mean. But everyone knows who they are, and they’re still in our streets.” She also asked, “Why does the City ignore us? We are being brutally abused.” She then called for an independent investigation of the circumstances surrounding her son’s death.

Individuals present during public comments were unanimous: “We’re a small city but we have big problems.” This statement was made by Alberto Ramirez, who emotionally detailed his experiences with Oxnard police officers:  “I’ve got bills from the hospitals because officers also abused me. And I end up having to pay for them – for the x-rays.” Appealing to the Commission, he asked that they “just help us out… the police are getting away with too much.”

Also, the marchers strongly urged the CRC to assess the large, discriminatory gap between the police budget (which consumes nearly 60% of the city budget) versus monies allocated to parks and recreation, youth programs, and the employment of local youth.

A sign displayed by a community member read “Crooks and Killers Step Down!” Foul play has long been an open secret at the Council Chambers of the City of Oxnard. Recently, the City was the target of a two-year FBI investigation that began with federal raids on the offices and homes of city officials and ended by uncovering what the Ventura County district attorney office has gently called, “a clear pattern of fiscal waste.” This pattern of waste and corruption has included “improper borrowing” by the currently-suspended City Manager Ed Sotelo as well as self-rewarded retirement perks. The DA’s report (read complete report here)also uncovered the usage of “virtually unlimited” city funds spent on “travel expenses” related to lavish vacations by city officials, including trips by the outgoing Mayor Tom Holden to the home of a wealthy Oxnard land developer—undoubtedly—an issue of conflict of interests. The disgraced mayor and suspended city manager are currently facing a combined $23,000 in fines from the state ethics agency.

Madre afligida comparte foto de hijo mostrando brutalidad que jugó papel en su muerte, Ciudad de Oxnard y Policía encubren mala conducta

(Oxnard, CA) El lunes 20 de agosto, 2012, más de cien residentes locales se reunieron en la Plaza de Oxnard antes de marchar por el centro y llegar al Concilio de la Ciudad donde denunciaron incidentes de abuso y brutalidad policial ante la Comisión de Relaciones Comunitarias (CCR) durante su junta. Saturada con fuerza y valor, la comunidad exigió que el CCR lleve a cabo su mandato de “promover las buenas relaciones humanas entre todos los habitantes de la ciudad,” y asegure que estas cuestiones se incluyan en la agenda de la próxima reunión del Consejo Municipal de Oxnard. La comunidad marchó hasta la sede del Departamento de Policía de Oxnard donde gritaban enérgicamente, “¡Policías asesinos, fuera de nuestras calles!” y otros lemas similares durante media hora antes de regresar al parque.

La Comisión le había comunicado al Colectivo Todo Poder al Pueblo, basado en Oxnard, que se iban a llevar acabo presentaciones formales sobre el tema durante la junta, y que la cuestión grave de mala conducta por parte del Departamento de Policía de Oxnard (OPD) se incluiría en la agenda oficial. Sin embargo, cuatro días antes de la reunión, los organizadores fueron informados que el administrador municipal interino Karen Burnham, el abogado de la ciudad Alan Holmberg, y el Jefe de la Policía Jeri Williams, se reunieron para lograr impedir que el tema fuera parte de la junta. A  pesar de este obstáculo, la persistencia de comunidad la llevó a testificar sobre sus experiencias de brutalidad policial y a presentar sus demandas durante los comentarios públicos de la sección “asuntos no incluidos en el orden del día.”

Las demandas de la comunidad exigen un cambio sistémico a las prácticas del Departamento de Policía de Oxnard con el fin de detener el patrón de abuso policial y brutalidad. Además, los presentes pidieron que se establezca una comisión independiente, basada en la comunidad, que funcione como Junta de Revisión de Quejas Policiales y que tenga el poder de tomar acción cuando agentes de la policía maltraten o abusen de la comunidad en cualquier manera.

La familia de Robert Ramírez, quien murió en la custodia del Departamento de Policía de Oxnard la noche del 23 de junio de 2012, se pronunció ante la CCR e hizo un llamado para una investigación independiente de la muerte brutal del joven. Preocupados por Ramírez, quien parecía estar pasando por una sobredosis de drogas, amigos de la familia buscaron atención médica llamando al 911. Testigos presentes (que desearon permanecer anónimos) informaron a la familia que vieron lo que parecía ser uso de armas Taser por parte de los policías, además de presenciar la golpiza salvaje del inofensivo y esposado joven a causa de entre siete a diez miembros de la policía de Oxnard. Además, los manifestantes instaron firmemente a la CCR para que evalúe la brecha grande y discriminatoria en el presupuesto municipal, comparando el departamento de policía (que consume casi el 60% del presupuesto de la ciudad) con las sumas asignadas a los departamentos de parques y recreación, programas y empleo para jóvenes locales.

Un letrero que mostró un miembro de la comunidad afirmó “¡Ladrones y Asesinos Fuera!” La mala conducta y la corrupción han plagado la ciudad por parte del Consejo Municipal. Recientemente, la ciudad fue sujeta a una investigación de dos años por el FBI que comenzó con incursiones federales en las oficinas y viviendas de los funcionarios de la ciudad, y terminó por descubrir lo que la oficina del abogado fiscal del Condado de Ventura ha llamado ligeramente, “un patrón claro de residuo fiscal.” Este patrón de malgasto y corrupción incluyó “préstamos indebidos” por Ed Sotelo, el administrador municipal actualmente suspendido, así como la auto-recompensa de beneficios de jubilación. Robert Ramírez

On the night of June 23, 2012, family friends of Robert Ramírez called 911 upon realizing that he needed medical attention after ingesting stimulants. Shortly after, Oxnard Police officers confronted 26-year-old Ramírez on the 1100 block of South ‘L’ Street. However, what ensued with the arrival of 7-10 officers resulted in criminal behavior—not only did officers prevent Ramírez from receiving urgent medical attention, they attacked him by using unnecessary excessive force even after he was handcuffed and posed no immediate physical threat to the officers and their actions directly resulted in his death.

ROBERT RAMÍREZ WAS NOT A GANG MEMBER

  • Despite erroneous reports from multiple media outlets, Robert Ramírez was not affiliated with a gang.
  • Vested interest from police authorities and their loyal media seek to tarnish and discredit Ramírez in order to take away from the fact that OPD officers murdered an innocent and harmless man.

OPD DELAYED MEDICAL ASSISTANCE

  • While the 911 call on June 23 was for medical assistance, this was denied by OPD. Not until Robert Ramírez was handcuffed and beaten unconscious did they allow emergency personnel to begin life-saving measures.
  • Ron Bamieh, the family’s attorney, has collected video evidence and witness testimonies which prove that Ramírez did not attack any officers but that they approached him first, took him to the ground, and began beating him. When you look at the evidence and injuries that resulted from the altercation, it is clear that he was beaten.

ROBERT RAMÍREZ WAS MURDERED BY OFFICERS FROM THE OXNARD POLICE DEPARTMENT

  • Despite OPD’s press release—and subsequent regurgitated reports by several media outlets—the fact remains that Ramírez died under police custody and that evidence demonstrates misconduct by OPD.
  • Contrary to OPD’s statements (via spokeswoman Monica Muñoz and Assistant Police Chief Scott Whitney), which claim that officers did not hit Robert or deploy less-than-lethal weaponry such as stun guns or Tasers, photographs and reports obtained from the coroner’s office confirm that Robert Ramírez’s body showed extensive bruises and physical trauma at the time of his death.

OXNARD MAYOR AND CITY COUNCIL HAVE YET TO TAKE ACTION

  • Although 7 (of the possibly 10) officers involved were placed on paid administrative leave following the incident, all officers resumed duty as of June 27.
  • Robert’s murder was arbitrary, unnecessary and racist. The community of Oxnard demands a full and complete investigation of OPD for the cover up and of the officers involved in the murder of Robert Ramírez.

ROBERT RAMÍREZ NO ERA PANDILLERO

  • A pesar de informes erróneos por múltiples medios de comunicación, Robert Ramírez no pertenecía a ninguna pandilla.
  • El interés de las autoridades policiales y sus medios aliados intentan deshonrar la imagen de Ramírez con el fin de ocultar el hecho de que los oficiales del OPD asesinaron a un joven inocente e inofensivo.

OPD IMPIDIÓ ASISTENCIA MÉDICA

  • Mientras la llamada al 911 fue para recibir asistencia médica, esto fue negado por el OPD. No fue hasta que Robert Ramírez fue esposado y golpeado, hasta quedar inconsciente, que le permitieron al personal de emergencia comenzar sus medidas salva-vidas.
  • Ron Bamieh, el abogado de la familia, ha logrado acumular evidencia en video y testimonios de testigos que demuestran que Ramírez no atacó a ningún oficial sino que ellos se acercaron primero a él, lo tumbaron al suelo y comenzaron a golpearlo. Cuando vemos la evidencia y  las lesiones en Ramírez producidas en el altercado, está claro que los oficiales lo golpearon.

ROBERT RAMÍREZ  FUE ASESINADO POR AGENTES DEL DEPARTAMENTO DE POLICÍA DE OXNARD

  • A pesar del lanzamiento de prensa del OPD y los malos informes por varios medios de prensa—el hecho es que Ramírez murió bajo custodia policial y que la evidencia muestra mala conducta por OPD.
  • A pesar de las declaraciones del OPD (a través de la portavoz Mónica Muñoz y el Asistente de Jefe de Policía Scott Whitney), que afirman que los agentes no golpearon a Robert ni implementaron armas como pistolas paralizantes o Taser, fotografías e informes de la oficina forense confirman que el cuerpo de Ramírez presentaba extensos hematomas y trauma físico en el momento de su muerte.

City Of Oxnard Attempts To Silence Community In Exposing Brutality By Blocking Issue From The Commission On Community Relations Agenda

On Monday, August 20th, community members, family and friends of Robert Ramirez, the young man that died while in the custody of the Oxnard Police department, will gather at 5pm at Plaza Park in Downtown Oxnard. This will be followed by a march to the Oxnard City Council Chambers, located at 305 E. Third Street, to the Commission on Community Relations (CCR) meeting at 6pm.

CONTEXT: Robert Ramirez’s Death in Custody of Oxnard Police Department Raises Question of Brutal Practices
Originally, the goal was to make a formal presentation to the CCR as an item on the agenda. However, as of Thursday August 17, the Interim City Manager, City Attorney and the Chief of Police have blocked the community from making a formal presentation. Community members will make public comments and demand an independent investigation into the clear circumstances leading to Robert Ramirez’ death at the hands of the Oxnard Police Department.

Carta abierta dirigida a asambleísta que expresó su apoyo para el mal conocido programa “Comunidades Seguras” de DHS-ICE

(Oxnard, CA) El Colectivo Todo Poder al Pueblo, con base en Oxnard, ha convocado una manifestación para el 28 de julio a las 12 de la tarde en frente de la oficina del asambleísta Das Williams, localizada en el Centro de Transporte de Oxnard. Organizaciones aliadas también han organizado una acción similar para el mediodía del viernes, 27 de julio, en frente de la oficina del asambleísta en Santa Bárbara. Ambas acciones tienen el propósito de exigir que Williams vote “Sí” en la Ley Trust Act de CA, AB 1081 (Ammiano) y así muestre su apoyo por las comunidades de personas indocumentados en la región.

Bautizada como la “primera ley anti-Arizona,” en referencia al proyecto de ley dura de Arizona en el Senado 1070, la entidad emisora ​​de Ley del Fideicomiso pondrá límites drásticos en el poder del gobierno federal para dictar los términos de la participación de las jurisdicciones locales en Comunidades Seguras (S -Comm), un programa del Departamento de Seguridad Nacional – Inmigración y Aduanas (DHS-ICE), exige la colaboración entre agencias de policía local y las autoridades federales de inmigración.

El periódico The Guardian del Reino Unido describió el programa de Comunidades Seguras de la siguiente forma, “en esencia… es la ley hermana de la ley [SB 1070] de Arizona.” De acuerdo a datos públicos, 7 de cada 10 de los 72,000  californianos que han sido deportados bajo S-Comm no tenían cargos o solamente tenían delitos menores. Las fuerzas de seguridad también han pronunciado que la confianza y las relaciones con residentes indocumentados se han debilitado drásticamente, ya que temen ser deportados por tener contacto con la ley. Por causa del programa, victimas de violencia doméstica y testigos a crímenes que acuden a la ayuda de agentes de policía han sido deportación.

Williams provocó indignación después de una entrevista con KEYT, el 6 de julio, en donde declaró: “No siento que tenga que votar a favor de una ley que impida la participación de California en el programa Comunidades Seguras.”

En una carta abierta presentada a Williams, mediante un representante el miércoles 25 de julio, el Colectivo Todo Poder al Pueblo afirmó, “Nuestra postura está clara e irrefutable: exigimos un fin a los abusos…Nos enfrentamos a usted como un legislador serio, un miembro de la Asamblea Estatal, y un representante elegido que finalmente es responsable ante la opinión pública.”

Todo Poder al Pueblo continuó, “La Ley Trust Act de CA busca solucionar estos problemas a través de la protección de nuestros derechos garantizados por la constitución, incluyendo: una audiencia justa en la corte, protección contra la discriminación racial y los falsos arrestos, la protección de niños y sobrevivientes de violencia doméstica, el mantenimiento de la transparencia en el gobierno, y el derecho de organismos locales de optar por no participar en el programa.”

Con base en Santa Bárbara, el grupo PUEBLO (Pueblo Unido para la Justicia Económica Desarrollando Liderazgo mediante la Organización) ha informado y advertido a la comunidad sobre S-Comm desde su introducción. “Cada semana PUEBLO recibe llamadas de personas cuyas familias han sido separadas por la deportación, de mujeres que temen denunciar casos de violencia doméstica por miedo a que puedan ser entregados a Inmigración y Aduanas (ICE). El programa Comunidades Seguras funciona como una red de deportación y que perjudica la confianza entre la policía y las comunidades de inmigrantes mientras que destroza la integridad de familias trabajadoras. Hacemos un llamado al asambleísta Das Williams para que esté con las familias trabajadoras, apoye la Ley Trust Act de CA y frene este programa de deportación que está fuera de control.”

Tomando en cuenta lo amigable que ha sido la comunidad migrantes con el asambleísta Williams, Todo Poder al Pueblo añadió, “Su apoyo para S-Comm es un asunto de grave importancia ya que podría socavar sus esfuerzos en el pasado por establecer solidaridad con los habitantes más vulnerables de nuestro estado…No nos queda más que exigir, en el lenguaje más fuerte y directo posible, que vote “Sí” a la Ley Trust Act de CA cuando llegue a la Asamblea del Estado.”

Nayra Pacheco, una estudiante indocumentada de cuarto año en la universidad UCSB, y representante del grupo estudiantil IDEAS (Desarrollando Sueños, Igualdad, Acceso y Éxito), dijo, “Esperamos que Das luche en contra de las políticas de inmigración que además de poner en riesgo los derechos de nuestras familias, ponen en riesgo nuestro derecho a la educación. S-Comm crea terror en las comunidades donde estudiamos, trabajamos y servimos como voluntarios, y no lo vamos a tolerar!”

Esta discusión controversial resulta en un momento crítico para Williams, ya que se enfrenta a una re-elección este 2012. En sus últimos esfuerzos electorales ha contado con la ayuda de las comunidades inmigrantes para registrar votantes y trabajar en su campaña.

El Colectivo Todo Poder al Pueblo ha convocado una manifestación que en frente de la oficina de Williams en el Centro de Transporte de Oxnard en la esquina de la Calle Cuatro y Oxnard Blvd. a las 12 PM de la tarde el sábado, 28 de julio.

También habrá una protesta el viernes, 27 de julio, a las 12 PM de la tarde, en la oficina de Das Williams en Santa Bárbara localizada en 101 W. Calle Anapamu.

Ambas manifestaciones se llevarán a cabo en solidaridad con el Día de Acción Nacional en Contra de La Ley SB 1070 de Arizona.

Open letter issued to Das Williams following support for notorious  DHS-ICE “Secure Communities” program

(Oxnard, CA) Oxnard-based Todo Poder al Pueblo Collective has called for a protest to be held in front of Assemblyman Das Williams’ office at the Oxnard Transportation center on July 28 at 12 noon. Allied organizations will hold a similar action at noon on Friday, July 27, in front of the Assemblyman’s office in Santa Barbara. Both actions are meant to demand that Williams votes “yes” on the CA Trust Act, AB1081 (Ammiano) and show his support for undocumented communities in the region.

Dubbed the “nation’s first ‘anti-Arizona law’” in reference to Arizona’s harsh SB1070, the CA Trust Act will place drastic limits on the power of the federal government to dictate the terms of local jurisdictions’ participation in Secure Communities (S-Comm), a Department of Homeland Security – Immigration and Customs Enforcement (DHS-ICE) program mandating collaboration between local law enforcement and federal immigration authorities.

The UK-Based Guardian newspaper has described Secure Communities as, “in essence… the sibling of Arizona’s law. [SB1070]” According to public data, 7 out of 10 of the 72,000 Californians deported under S-Comm have had either no convictions on their records or only minor offenses. Law enforcement agencies have also stated that it has drastically undermined relations with undocumented residents who now fear deportation as a result of contact with police officers. Domestic-violence victims and witnesses of crimes have faced deportation proceedings as a result of the program.

Williams provoked outrage after a July 6 interview with KEYT where he stated, “I don’t feel like I should be voting for a law to stop California’s participation in Secure Communities.”

In an open letter submitted to a representative of Williams on Wednesday, July 25, the Todo Poder al Pueblo Collective stated, “Our stance is clear and unequivocal: we demand an end to the abuses… We’re addressing you as a serious lawmaker, a Member of the State Assembly, and an elected representative that is ultimately accountable to public opinion.”

Todo Poder al Pueblo continued to explain that “the CA Trust Act seeks to remedy these problems through protections of our constitutionally-assured rights including a fair hearing in court, protections against racial profiling and pre-textual arrests, protection for children and survivors of domestic abuse, the safeguarding of government transparency, and the right of localities to opt-out of the program.”

Santa Barbara-based PUEBLO (People United for Economic Justice Building Leadership through Organizing) has been raising awareness regarding S-Comm since its introduction. “Every week PUEBLO receives calls from people whose families have been torn apart by deportation, from women afraid to report domestic violence for fear that they might be turned over to Immigration and Customs Enforcement (ICE).  Secure Communities is a dragnet deportation program that erodes trust between police and immigrant communities and tears at the integrity of working families.  We call on Assemblymember Das Williams to stand with working families, support the TRUST Act, and rein in this out of control deportation program.”

Noting the immigrant-friendly nature of Assemblyman Williams’ past voting record, Todo Poder al Pueblo added, “[your] support for S-Comm is a matter of grave concern that undermines your past efforts to stand in solidarity with the most vulnerable residents of our state…  We have no choice but to demand, in the strongest and most forthright language possible, that you vote ‘Yes’ on the CA Trust Act when it reaches the State Assembly.”

Nayra Pacheco, an undocumented senior at UCSB and representative of IDEAS (Improving Dreams, Equality, Access and Success), said that “We expect Das to fight against insecure immigration policies that threaten not only the rights of our families, but our educational rights as well. S-Comm creates fear in the community we study, work, and volunteer in and we will not stand for it!”

This controversy comes at a sensitive time for Williams, who is up for re-election in 2012.  In past electoral efforts he has relied on the support and contribution of immigrant communities who have precinct-walked, registered voters, and sustained his election campaign.

The Todo Poder al Pueblo Collective has called for a protest to be held in front of Williams’ office at the Oxnard Transportation Center on the corner of East Fourth St. and Oxnard Blvd. at 12PM on Saturday, July 28.

An additionl protest will take place  12PM on Friday, July 27, at Das Williams’ office in Santa Barbara located at 101 W. Anapamu Street.

Both actions will be held in solidarity with the National Day of Action Against Arizona’s SB1070.

I am with you on so much, including talking with Gil Cedillo about tackling the unlicensed driver issue before he leaves the legislature in Sept. However, Your press release does not seem to indicate that you want a dialogue. In fact, it makes it very difficult to consider your position. Now, even if you convinced me it’s good policy, I would look like I’m caving to your accusations of lying and worse. Not a great method.

In fact, the press release makes me think your primary objective is to declare a victory and get publicity for the collective. You shield have someone outside this read it, see how it comes across.

This is what happened when I reached out to James Joyce III, Das’ field rep, to have a discussion with him about where Das Williams stands on the TRUST ACT.

Pieter, 

Both Das and I appreciate your support. Wanted to drop you this message from Das on his stance. Please let me know if you have any questions, there seems to be a lot of mis information out there. Das never voted against the Trust Act, the last time he had a chance to vote on this legislation was May 2011. The next time will be in Aug. Some things have changed since then. 

From Das: 

Personal attacks have been launched against me because I have some questions about a piece of legislation moving through the legislature. When AB 1081 was before me in 2011 I did not vote for it because I had concerns about the ability for law enforcement to place felons in ICE holds. There are aspects of the bill that I support – anti-profiling; protection for witnesses and victims of crimes by others. There are some that I have concerns – would it prevent law enforcement from holding a felon who can post bail, possibly going back to the community and inflecting more harm to victims. I am reviewing the new language in the bill and the data that shows local communities have abused the ICE hold process and want to talk to my constituents about the bill. In the end, we may not agree but to do my job I must review all aspects of the legislation that comes before me.

I supported the Dream Act, I voted for SB 126 that gave protections to agricultural workers, I have marched in solidarity with immigrant groups and I have always had an open door to my constituents. I didn’t embrace this philosophy late in my public service. When on the Santa Barbara City Council I supported limiting check points and worked with other councilmembers to make Santa Barbara a safe city for all residents.

Let me be clear, I want to see anti-profiling and victim protection while ensuring that those guilty of hurting our community do not have the opportunity to do it again.

Familia de Oxnard Exige Investigación Imparcial

La noche del 23 de junio de 2012, agentes de la Policía de Oxnard (OPD) enfrentaron a Robert Ramírez en la cuadra 1100 de la calle “L” Sur. Amistades de la familia llamaron al 911 después al descubrir que Ramírez necesitaba atención médica urgente. Sin embargo, lo consecuente fue más que negligencia por los oficiales de OPD y posiblemente criminal – no sólo impidieron que Ramírez recibiera atención médica, pero es posible que sus acciones hallan resultado en la muerte de este joven de 26 años de edad.

El 12 de julio, una conferencia de prensa se llevó a cabo en la oficina de abogados Bamieh y Erickson en Ventura. Sentada estoica ante la prensa, Teresa, la madre de Robert Ramírez, dijo que su familia “sólo busca la verdad sobre los hechos que sucedieron la noche de la muerte de Robert. En este momento, no tenemos planes de hacer nada, simplemente queremos llegar a la verdad y compartirla con nuestra comunidad.”

Mientras que la familia Ramírez está de luto, el abogado de la familia, Ron Bamieh, ha mantenido claro que va a centrar su investigación en los oficiales involucrados. Bamieh declaró; “Sabemos por testimonios de testigos que había entre siete y diez oficiales y que todos descendieron sobre Robert. Basados en la totalidad de la evidencia que hemos visto, creemos que el numero era más cerca de diez que siete.” Además, Bamieh agregó que el FBI está investigando el caso y que los cargos criminales podrían ser ejercidos por el Abogado de Distrito del Condado de Ventura o el Abogado de los Estados Unidos.
A pesar de las investigaciones por la unidad de homicidios del Departamento de Policía de Oxnard, y la Oficina del Abogado del Condado de Ventura, la familia Ramírez exige una investigación independiente e imparcial.

La policía sabia que Robert había ingerido drogas y que posiblemente se tratara de una sobredosis, sin embargo, esta información no se tomo en cuenta a la hora de de-escalar el encuentro. Los agentes descendieron de forma agresiva sobre Ramírez, quien no llevaba armas ni presentaba un riesgo físico a los oficiales. Mientras que el propósito de la llamada al 911 fue pedir asistencia médica, esto fue negado por los oficiales. No fue hasta que Robert fue esposado y golpeado hasta quedar inconsciente que se permitió que el personal de emergencia comenzara sus medidas de salva-vidas.

Bamieh, que tiene 20 años de experiencia trabajando en casos de justicia penal, afirmó que “la evidencia está muy clara que Robert no ataco ni golpeo a los oficiales…que los oficiales lo atacaron a él primero…que lo aventaron al piso…que lo golpeaban repetidamente…Cuando evaluamos las lesiones producidas por el altercado, queda claro que lo golpearon. ” El abogado agregó que no conoce de ningún protocolo policial que requiera golpear a un sujeto en la cabeza o cara, o el uso de estrangulación o de armas Taser, cosas que han sido confirmadas por numerosos testigos. Bamieh estableció que su oficina adquirió evidencia en vídeos que pueden ser utilizados como pruebas para el caso.

Según la representante del Departamento de Policía de Oxnard, Mónica Muñoz, ninguno de los agentes implicados en el asalto resultaron heridos. Aunque los oficiales involucrados fueron puestos en vacaciones pagadas después del incidente, todos volvieron a ocupar sus puestos el 27 de junio. Muñoz dijo que los oficiales no golpearon a Robert ni implementaron métodos letales, como pistolas paralizantes o armas Taser. Sin embargo, las fotografías obtenidas por Bamieh por la oficina del médico forense contradicen las declaraciones de Muñoz ya que muestran que el cuerpo de Robert tenia una gran cantidad de contusiones y traumas físicos en el momento de su muerte. El informe oficial de autopsia aun está pendiente.

Durante la conferencia de prensa, una mujer que no pertenecía a los medios de comunicación intentó entrar en las oficinas de Bamieh. Ella respondió que era de la oficina de OPD cuando el abogado le pidió que se identificara, y él inmediatamente le informo que no había sido invitada ni era bienvenida en la conferencia de prensa. Bamieh escoltó a Mónica Muñoz fuera de las instalaciones.

Este caso plantea cuestiones elementales. ¿Fue asistencia médica para Robert atrasada a propósito? ¿Qué efecto tiene este incidente en la comunidad? Como fue el caso de Rodney King, Thomas Kelly, y muchos otros, este incidente es un ejemplo más de la desenfrenada brutalidad policial que predomina en nuestras comunidades. Este patrón de práctica abusiva por parte del Departamento de Policía de Oxnard ha creado un ambiente de temor en nuestras vecindades. Nuestra comunidad exige justicia – una investigación imparcial del asesinato de Ramírez, y castigo a los culpables de este crimen. La militarización de nuestras comunidades debe terminar, y los policías asesinos deben ser investigados agresivamente y ser retirados de nuestras calles!

Oxnard Family Demands Impartial Investigation

On the night of June 23, 2012, Oxnard Police officers confronted 26-year-old Robert Ramírez on the 1100 block of South ‘L’ Street. Upon realizing that Ramírez needed medical attention, family friends called 911. However, what ensued was beyond simple negligence by the Oxnard Police Department and may have been criminal – not only did officers prevent Ramírez from receiving urgent medical attention, but their actions may also have directly resulted in his death.

On July 12, a press conference was held at the Law Offices of Bamieh and Erickson in Ventura. Sitting stoically before the press, Ramírez’s mother, Teresa, stated that her family “are only looking for the truth of what happened on the night of Robert’s death. At this point we have no plans to do anything but to find the truth and share it with our community.”

As the Ramírez family mourns, the family’s attorney, Ron Bamieh, has made clear that he will focus his investigation on the police officers in question. Bamieh stated, “We know from eyewitnesses there were seven to ten officers there who all descended upon Robert. We believe it was closer to ten than seven, based on the totality of the evidence that I have viewed.” Bamieh added that the FBI is investigating the case, and that criminal charges could be brought by the Ventura County District Attorney or the U.S. Attorney.

Although the Oxnard Police Department’s homicide unit and Ventura County District Attorney’s Office are investigating the incident, the Ramírez family is demanding an impartial independent investigation. The police were informed that Robert had potentially overdosed on stimulants, information which should have been taken into account when deescalating the encounter. Instead, the officers aggressively descended upon Ramírez, who was unarmed and posed no immediate physical threat to the officers.

While the original 911 call was for medical assistance this was denied. It wasn’t until Robert was beaten unconscious and handcuffed that emergency personnel were allowed to begin life-saving measures. Bamieh, who has a 20 years of experience in criminal justice casework, stated that “Evidence is very clear that Robert did not attack or hit any officers…that officers approached him first….that they took him to the ground…that they were punching at him….When you look at the injuries that resulted after the altercation, it’s clear that he was beaten.” The attorney added that he knew of no police protocol requiring the striking of suspects in the head or face or the use of choke holds and Tasers, all of which have been confirmed by numerous witnesses. Bamieh established that his firm has collected video footage to be used as evidence in the case.

According to Oxnard Police Department spokeswoman Monica Muñoz, none of the officers involved in the assault were injured in the incident.  Although the officers involved were placed on paid administrative leave following the incident, all resumed their jobs as of June 27. Muñoz stated that the officers did not hit Robert or deploy less-than-lethal weaponry such as stun guns or Tasers. However, photographs obtained by Bamieh from the coroner’s office directly contradict Muñoz’s statements, showing that Robert’s body was left with an extensive amount of bruises and physical trauma at the time of his death. Official autopsy reports are currently pending.

During the press conference, an unidentified woman attempted to enter the press conference. Bamieh asked her to identify herself, and when she stated she was from the OPD the attorney promptly notified her that she was neither invited nor welcome at the press conference. Bamieh escorted Monica Muñoz off the premises.

The case raises some very important questions. Was medical assistance delayed on purpose? What effect does this incident have on the community?  As was the case with Rodney King, Kelly Thomas, and countless others, this incident is yet another example of the rampant police brutality prevalent in our communities. This pattern of abusive practice on the part of the Oxnard Police Department has led to a culture of fear in our neighborhoods.

Our community demands justice — an impartial investigation of the murder of Ramírez, and the punishment of those guilty of this crime. The militarization of our communities must end, and killer cops must be aggressively investigated and removed from our streets!
